You are invited to the Dinner Educational Program "Cause of Massive Roof Leaks Disputed – Insights from Subrogation Case'" on Wednesday, October 21st from 6:00 - 8:00pm at Zio Fraedo's in Pleasant Hill.

Intense rain near the end of a reroof job produced massive leaks in a five-star hotel. Property insurance investigators confirmed intense rainfall and concluded the leaks were the result of improper temporary protections. The insurance company settled with the owner, obtained “subrogation” rights, and sued everybody.

The expert defending the roof contractor opined the temporary protections were “proper” and that the cause of massive leaks was “beyond-code” rainfall, undersized roof drains, ponded water overtopping flashings, and delays due lack of direction how to flash very low equipment platforms. A mediated settlement resulted in a lower-than-expected payout by defense insurance carriers and several investigation insights for roof professionals.

Learning Objectives – Facilitate roof professionals forming their own opinions about:

  • How above-code events impact insurance coverage and Standard of Care arguments.
  • What the “volume” of leaks says about ponded vs non-ponded conditions.
  • Rational of using close but “unofficial” rainfall sources rather than only official sources further away.
  • Comfort level of offering opinions based on less than complete data.
  • Reasonable allocations to parties (attendees will be asked to serve as jurors.).
