Program Description:

Expert Testimony – Understanding the Role

Expert testimony is necessary to support or refute construction contract, delay and defect disputes. Education, peer-reviewed publications, and real-world experience can provide the background required to serve as an expert witness. Expert testimony may strengthen the litigators argument or refute an alternative viewpoint or opinion. Having the knowledge is important, but understanding the expert’s role and the needs related to the specific matter are critical in ensuring your success as an expert witness. As an expert, it is vital to understand how the investigations you perform will ensure that your opinions are persuasive, supported and admissible at trial or in arbitration.

Biographies

Allison Andersen: Ms. Andersen represents community associations in corporate governance, operational, transactional, and civil litigation matters. She has over nineteen years’ experience in litigating issues related to insurance coverage, real estate fraud and disclosure, operating and reserve funding, contract interpretation and compliance, complex construction defect, condominium conversion, free speech, and the enforcement of covenants, conditions and restrictions. Ms. Andersen has also defended associations, their directors and officers against claims for violation of the fair housing and disability laws, personal injury, harassment, failure to maintain association property, failure to comply with the Open Meeting Act, failure to comply with the member election statutes, breach of fiduciary duty, and breach of contract matters. Ms. Andersen currently serves as a Legislative Co-Chair on the Executive Committee of CAI’s California Legislative Action Committee. She has been awarded an AV-Preeminent rating by Martindale-Hubbell representing her high level of professional excellence.

J. Spencer Edgett: J. Spencer Edgett is a partner with Chapman & Intrieri, LLP and since 2004 has primarily focused his practice on representing community associations both as general counsel and in successfully litigating and resolving numerous complex multi-million dollar construction defect claims. Mr. Edgett also regularly advises and assists community association managers and board members on all aspects of management and operations including fiduciary responsibilities, drafting and revising governing documents, vendor contract negotiations, collection matters and enforcement issues. Mr. Edgett has published several articles related to common interest development law and community associations and has presented to homeowners and managers at various industry related educational seminars and workshops.
