About Allison L. Andersen, Esq.

 Ms. Andersen represents community associations in corporate governance, operational, transactional, and civil litigation matters. She has over seventeen years’ experience negotiating and litigating CC&R enforcement, real estate fraud and disclosure, contract interpretation and compliance, breach of fiduciary duty, fair housing, free speech, due process, construction defect, and insurance coverage matters.  

Ms. Andersen specializes in complex construction defect matters. She has successfully mediated the settlement of claims for water intrusion at exterior cladding systems (siding, stucco, stone veneer and curtain walls), roofing systems, windows, balconies, decks, stairways and entry landings; mechanical systems (hot water distribution, air conditioning, humidity control, gray water discharge); structural systems; foundation systems (post-tensioned slab on grade and elevated podium deck structures); electrical systems; acoustical systems; and civil infrastructure including site drainage, reclaimed water distribution, attachment of municipal sewer mains to private lots, differential settlement, soil stability and groundwater dewatering systems.

Ms. Andersen achieved notable success managing condominium conversion claims through settlement and trial. This experience includes the evaluation of developer compliance with applicable condominium conversion laws, sufficiency of developer prepared operating and reserve budgets, sufficiency of developer disclosures to condominium associations and members, and the investigation of converters’ construction practices.

About David Field 

 Coming from a background of custom residential design, David is very familiar with the challenges and intricacies of residential construction. He received his Bachelor of Arts in Architecture from the University of California at Berkeley in 1995 and received his Master of Architecture from the University of Colorado at Denver in 1998. Working at multiple design firms during those years, his responsibilities included drafting, design, and sight observation.

Then, in 2000, David began working at Richard Avelar & Associates where he performed litigation support duties, including site observation and code compliance analysis. Then, after obtaining his Architect’s license in 2004, he began assisting with post-litigation reconstruction in both repair design and contract administration. Currently, David performs forensic investigation and expert witness services, including building performance and code compliance review, repair specifications, and contract administration.

About Michael T. Kennedy, Jr. 

Michael T. Kennedy, Jr. is a Partner of Berding | Weil in the litigation department. Michael has been involved in residential and commercial construction litigation for over 20 years, dating to his time working full time during law school for a firm representing homeowners in construction defect matters.

Michael’s experience and insight into the construction industry helps quickly identify building defects and the necessary investigation methods. This knowledge leads to concise investigations, which ultimately saves the experts’ time and this savings is then passed onto our clients.

About William Lepowsky 

William Lepowsky has been a statistical consultant and expert witness for more than 30 years, working in particular on dozens of construction defect cases over the past couple of decades. Bill is also an instructor of mathematics and statistics at Laney College in Oakland where he has been teaching adults for over 50 years, and he has authored an introductory textbook, Statistics in Action.   

In construction defect cases, Bill has testified about the use of confidence intervals as well as Bayesian methods. In addition, he has created original computational tools to deal with the mathematical complexity of stratified sampling. 

Bill majored in math at Harvard where he received his B.A. summa cum laude, later earning three graduate degrees (in mathematics and statistics) at U.C. Berkeley.
